Rajasthan High Court Rules: Student Union Elections Cannot Override Right to Education

Jaipur: The Rajasthan High Court has rejected the petition seeking to lift the ban on student union elections in the state. While acknowledging that student union elections are a democratic right, the court clarified that they cannot take precedence over the fundamental right to education. Justice Sameer Jain, during the hearing, directed the state government to frame a clear policy regarding the conduct of such elections.

Petition Rejected, But Student Leaders Optimistic

Although the court did not lift the ban, student leaders expressed satisfaction with the High Court’s decision. Niraj Khichad, a prominent student leader, stated that he welcomes the court’s directive to the government to formulate a policy. He expressed hope that any future policy would protect students’ democratic rights. Khichad also noted that the court understood the sentiments of the student community and did not make any adverse remarks against student union elections.

Uncertainty Over Upcoming Elections

It remains unclear whether student union elections will take place in Rajasthan’s colleges and universities. The High Court did not issue any explicit orders mandating elections, leaving the decision to the state government. Once the policy is framed, the government will decide not only whether elections will be held but also whether they will follow the recommendations of the Lingdoh Committee or a new framework.

Ban Imposed During Gehlot Government

The ban on student union elections was imposed nearly three and a half years ago during the previous Congress government under Chief Minister Ashok Gehlot. At that time, the Department of Higher Education decided not to conduct elections. Since then, students have been actively protesting for the restoration of elections. Earlier, a similar ban in 2006 had been lifted in 2010, after which student elections were resumed.
